聊城市市政經(jīng)營開發(fā)中心(甲方) 聊城市火車站廣場LED宣傳屏使用權(quán)經(jīng)由                     在國內(nèi)平臺進(jìn)行公開拍賣,                   (乙方競拍得租賃權(quán),。甲,、乙雙方根據(jù)《中華人民共和國民典法》和其他法律、法規(guī)的規(guī)定,,并按照公正,、平等,、自愿、誠實(shí)信用的原則,,同意按照以下條款和條件,,簽署本合同。

第一條 具體位置及內(nèi)容

2.內(nèi)容:聊城市火車站廣場LED宣傳屏使用權(quán)

第二條 合同期限和費(fèi)用

1.合同         日起        日止,,租賃期叁年,。在執(zhí)行合同期間,若遇上級政策改變或甲方業(yè)務(wù)范圍變動,,甲方有權(quán)終止合同或?qū)贤瑑?nèi)容進(jìn)行變更,。

2.租賃合同期滿或終止解除,乙方應(yīng)如期交還所租賃電子屏,;乙方逾期不交還的,,甲方有權(quán)收回所租賃電子屏

第三條 雙方責(zé)任

1.乙方根據(jù)競拍得的LED電子宣傳設(shè)施的宣傳時間,,保證60%宣傳時間用于公益宣傳,,40%宣傳時間進(jìn)行商業(yè)宣傳。乙方應(yīng)自覺遵守甲方各項(xiàng)規(guī)章制度并服從甲方的監(jiān)督管理,。

2.甲方有權(quán)監(jiān)督檢查LED電子宣傳屏的合法,、合理使用;乙方發(fā)布的商業(yè)宣傳廣告形式與內(nèi)容應(yīng)符合《中華人民共和國廣告法》及相關(guān)法規(guī),、規(guī)章的要求,,不侵犯他人知識產(chǎn)權(quán)。因廣告的制作,、發(fā)布內(nèi)容(包括但不限于商標(biāo),、肖像、廣告詞及其它廣告內(nèi)容)引起的法律糾紛和責(zé)任由乙方承擔(dān),。甲方有權(quán)要求乙方撤除和整改不符合法律規(guī)定,、不符合委托人規(guī)定的內(nèi)容和版面(包含醫(yī)院廣告、醫(yī)療廣告等),;如違法發(fā)布廣告造成他人人身,、財產(chǎn)損失等情形的,,乙方應(yīng)充分賠償因此而給甲方造成的一切損失(包括但不限于委托人因此向第三方支付的違約金、賠償金,、行政處罰金及訴訟費(fèi),、差旅費(fèi)、律師代理費(fèi)等各項(xiàng)費(fèi)用),。

3.甲方有權(quán)審查乙方商業(yè)宣傳的設(shè)計(jì)方案,,對乙方制作,、發(fā)布的內(nèi)容和版面進(jìn)行查驗(yàn);如乙方在設(shè)計(jì)和發(fā)布過程中存在安全隱患和責(zé)任風(fēng)險的,,甲方有權(quán)要求乙方進(jìn)行整改,;乙方負(fù)責(zé)對LED電子宣傳屏的保養(yǎng),、維護(hù)、維修,、保潔等,,所產(chǎn)生的費(fèi)用自行承擔(dān)。如存在安全隱患或外觀破損,,甲方有權(quán)要求乙方進(jìn)行保養(yǎng)維護(hù),,否則甲方有權(quán)進(jìn)行維護(hù),產(chǎn)生的一切費(fèi)用及后果由乙方承擔(dān),。

4.甲方有需發(fā)布公益性廣告不僅限于節(jié)假日或重大宣傳時間),,乙方需無條件服從乙方必須確保公益宣傳有效的宣傳時間,。

5.乙方依法遵守相關(guān)法律法規(guī),,負(fù)責(zé)LED電子宣傳屏設(shè)施的治安、消防,、衛(wèi)生,、用電等安全工作,并承擔(dān)責(zé)任,。租賃期間,,乙方必須保證宣傳設(shè)施的安全,,出現(xiàn)任何問題(不限于天氣等因素)造成安全責(zé)任與損失,,均由乙方自行承擔(dān),。

6.租賃期間,不得將承租拍得物進(jìn)行任何形式的抵押,、擔(dān)保,,否則甲方有權(quán)單方面解除合同并追究相應(yīng)責(zé)任。

8.乙方承擔(dān)LED電子宣傳屏租賃期間所產(chǎn)生的用電,、用水,、人員操作及維護(hù)維修費(fèi)用。

9.乙方有義務(wù)愛護(hù)并合理使用各項(xiàng)設(shè)施,,如需改動應(yīng)先書面申請并征得甲方同意,損壞部分還應(yīng)承擔(dān)修復(fù)或賠償責(zé)任,。

10.合同所涉及到的LED電子宣傳屏設(shè)施,,雙方達(dá)成協(xié)議后,保證所移交的宣傳設(shè)施質(zhì)量可靠,,如有質(zhì)量問題,,雙方協(xié)商解決。

11.甲方以外的不可抗拒的因素須收回使用權(quán)的,,乙方須無條件服從,,雙方不承擔(dān)任何責(zé)任和損失

12.甲方,、政府,、甲方的上級主管部門因國家、城市建設(shè),、主管部門規(guī)劃與管理需要收回使用權(quán)的時,,雙方應(yīng)無條件配合整體規(guī)劃與管理工作,雙方不承擔(dān)任何責(zé)任和損失,。

第四條 其他約定

1.合同期滿后,,甲方根據(jù)各乙方工作情況,,考慮是否續(xù)簽服務(wù)合同或重新組織招標(biāo)。

2.因不可抗力致使一方不能及時或完全履行合同的,,應(yīng)及時通知另一方,,雙方互不承擔(dān)責(zé)任,并在15天內(nèi)提供有關(guān)不可抗力的相應(yīng)證明,。合同未履行部分是否繼續(xù)履行,、如何履行等問題,可由雙方協(xié)商解決,,并以書面形式給予確定,。

第五條 合同解除的條件

有下列情形之一的,本合同終止,,甲乙雙方互不承擔(dān)違約責(zé)任:

1.因法定不可抗力致使設(shè)施設(shè)備毀損,、滅失或造成其他損失而無法繼續(xù)使用的;

2.非甲乙雙方因素致使合同終止的其他情形,。

乙方有下列情形之一的,,甲方有權(quán)解除本合同:

1.不支付或者不按照約定支付租金;

2.不支付或者不按約定支付應(yīng)由乙方負(fù)擔(dān)的各項(xiàng)費(fèi)用,;

3.未經(jīng)甲方書面同意,,乙方擅自改變該合同約定用途;

4.違反合同約定不承擔(dān)維護(hù)責(zé)任致使設(shè)備設(shè)施損壞,;

5.從事違法活動,;

6.雙方約定的其他情形。

第六條 爭議的解決方式

合同發(fā)生糾紛時,,雙方應(yīng)協(xié)商解決,,協(xié)商不成可以采用下列方式解決:

(1)提交聊城仲裁委員會仲裁;

(2)向甲方當(dāng)?shù)厝嗣穹ㄔ浩鹪V,。

本合同發(fā)生糾紛,,經(jīng)雙方協(xié)商不能解決時,首先采用(1)種方式予以解決,。

第七條 補(bǔ)充協(xié)議

1.合同未盡事宜,,經(jīng)雙方協(xié)商可簽訂補(bǔ)充協(xié)議,所簽訂的補(bǔ)充協(xié)議與本合同具有同等的法律效力,。合同補(bǔ)充條款不應(yīng)違背原合同實(shí)質(zhì)性內(nèi)容,。
